Influence of Sharia Law or Islamic Law
Sharia law or Islamic law are rules or laws that originate from the Qur’an and Hadith. This law was made for Muslims.
Sharia law was created to guide Muslims to the truth. However, unfortunately, despite the advantages and goodness of the contents of sharia law, not a few non-Muslims use it in their daily lives.
Although these laws are intended for Muslims, several countries establish them as their state ideology. Like Indonesia, not because Muslims are the majority but rather because from the start, Islamic law or sharia law formed the ideology of the Indonesian nation.
With the explanation above, you need to know the influences of sharia law in Indonesia.
The following is the influence of sharia law in Indonesia:
- Civil law
The Islamic Civil Code includes Munakahat (everything about marriage, divorce, and its legal consequences). Wirasat (heirs, heirs, inheritance, administration of all matters relating to the distribution of assets); Muamalah (in a unique sense, rights to material things and things, human relations in sales, leases, loans, associations, contracts, etc.) regulations).
- Public law
Islamic Public Law contains Jinayah (Rules for Criminal Conduct). Al-Ahkam as-Sulthaniyyah (speech by heads of state/heads of government, central and local government rights, taxes, etc.); Siyar (issues of war and peace, relations with adherents of other religions and countries); and Mukhasamat (judicial, judicial and procedural law).
- Criminal law
Islam stipulates that people who commit adultery are publicly threatened with a hundred lashes (QS. An-Nur 2). (Sura al-Isra “32), usury is forbidden because it is unfair to weak people (QS. Al-Baqarah 278-279), creditors are forced to promise me that I must give time to my debtors. If the debtor cannot pay it, the creditor must donate it to zakat (QS. Al Baqarah 280).
God’s law establishes universal rules for human behavior with a unique moral code. Since Islamic morality has specific moral standards, moral changes in Islamic society are limited to a narrow range.
This means that growth that deviates from what was initially thought to be a good or lousy trajectory deviates in such a way that there are few options.
