PPKI UMSU Receives a Visit from the Legal and Human Rights Policy Strategy Agency of the Ministry of Law and Human Rights RI

The Intellectual Property Management Center of Universitas Muhammadiyah Sumatera Utara (PPKI-UMSU) received a visit from the Legal and Human Rights Policy Strategy Agency of the Ministry of Law and Human Rights of the Republic of Indonesia (Kemenkumham RI), Tuesday (5/9) at the PPKI-UMSU Office on Muchtar Basri Street No.3 Medan.

This visit aims to get views from academics and practitioners about intellectual property rights. Then, discuss the role of Collective Management Institutions and mechanisms in managing royalties for creators, including the role of the government and current policies. This is related to providing economic rights protection for creators, so it requires a study on royalty management policies by the Collective Management Institution (LMK).

Present during the visit were Okky Chahyo Nugroho, S.H., M.Si as an intermediate researcher and Antonio Rajoli Ginting, S.H., M.H. as the First Policy Analyst from the Legal and Human Rights Policy Strategy Agency, Ministry of Law and Human Rights, accompanied by Fauzi Iswahyudi, S.H., M.H., and Dr. Eka NAM Sihombing from the North Sumatra Regional Office of the Ministry of Law and Human Rights.

According to the UMSU PPKI Institute Chairperson, Faisal Riza, S.H., M.H., the Collective Management Institution (LMK) is the mandate of Law Number 28 of 2014 concerning Copyright. Then, it is given the authority to collect royalties from copyright users and distribute royalties to the creators.

“The Collective Management Institution must apply for an operational license to the minister with the condition that it is in the form of a non-profit legal entity, authorized by the creator or copyright holder to attract, collect, and distribute royalties,” said Faisal.

Given the critical role of the LMK in managing royalties, the government and other stakeholders who care about Intellectual Property Rights need to conduct more intense socialization regarding royalties so that the wider community, especially creators, are not harmed by their economic rights and can also strengthen the existence of the Collective Management Institution itself.

Meanwhile, Okky Chahyo Nugroho, S.H., M.Si explained that socialization has always been and continues to be carried out, but there are still areas for improvement because the socialization process is ongoing.

“The government, especially DJKI (Directorate General of Intellectual Property), also always socializes with the regions, but of course, we are also still studying other formulas so that friends in the regions can find out the information,” said Okky.

Okky also said that this visit was in the context of conducting a study and collecting field data information to evaluate royalty management policies by the Collective Management Institution.
